The papers now sent to us by the Cabinet Offices at 10 are those which Mr. Hazelrigg assumed had reached us before his visit last December. If they had, the position would then have been clearer.

In paragraph 5 of the letter at 9 we suggested that the War Activities Committee should review the Kotewall case. In fact they had done so and their recommendation (enclosed with 10) was that Sir R. Kotewall should be detained pending a public trial.

The Commander in Chief had already decided not to accept this recommendation when he sent Mr. Hazelrigg to this country for advice on the Li Tse Fong case. He had, however, ruled that Kotewall had forfeited his position and should withdraw from public lire. On our information the cases of R. Kotewall and Mr. Li Tse Fong are nd sufficiently dissimilar to warrant different treatment, The letter at 3 makes clear our view on this point.

The Commander in Chief in his covering note at 10 asks that these papers may be passed to the Secretary of State "for his information". ? we need

therefore take no action on them for the present, but can await any reaction that may result from Mr. Lloyd's letter to Brigadier MacDougall at 3.

I have made an extract or paragraph 6 of 9 for registration separately in connection with consideration of the instruments necessary to effect the change over from military to civil government.

I should not have thought that this file need any longer be top secret. I agree with Mr. Bates that it should remain "General" but be sent to me in

first instance.
